Please read this Agreement carefully. The following are the Terms and Conditions for the use of Intrepidus FX, provided to you by Elite E Services Limited. By enrolling as a Subscriber, you agree to be bound by these Terms and Conditions, including but not limited to all payment terms, policies, practices, rules, standards and guidelines. You agree that you are bound by these Terms and Conditions whether you are acting on your own behalf or on behalf of a third party. You further agree that any of your agents, representatives, employees, or any person or entity acting on your behalf with respect to the use of Intrepidus FX, shall be bound by, and shall abide by, these Terms and Conditions. By using Intrepidus FX, the user agrees that the author and any other entities associated with Intrepidus FX and/or Elite E Services Limited shall not be held liable for any direct, indirect, consequential loss or any damages whatsoever arising from this usage, or the use of any information, signals, software, messages, manual, worksheet, instructions, alerts, directives and any other information contained relevant to its use and understanding.
No guarantee of performance, results or any other anticipated return on investment is offered at any time. Past performance is not indicative of future results.
It should be understood that there is always a relationship between high reward and high risk. Any type of market or trade speculation that can yield an unusually high return on investment is subject to unusually high risk. Only surplus funds should be placed at risk and anyone who does not have such funds should not participate in trading foreign currencies. It should also be understood that hypothetical performance results may be posted on the website or given to third parties by other methods. Such hypothetical performance results have inherent limitations in that they have been prepared with the use of past performance and past performance is no guarantee of future results. Performance can and does vary between individuals. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. In fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk in actual trading. For example, the ability to withstand losses or adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical results.
Currency trading includes high risk and you can lose some or all of your investment.
The financial information provided hereunder is provided "as is" and "with all faults." Subscriber acknowledges there may be delays, errors, omissions, inaccuracies or interruptions of service and that Elite E Services Limited specifically disclaims any and all warranties, express, implied, statutory or otherwise relating to the method or manner of dissemination of the information provided by Elite E Services Limited or the financial information provided by any third party financial information suppliers or any commodity, stock or other exchanges. Elite E Services Limited specifically disclaims any and all statutory or implied warranties of merchantability or fitness for a particular purpose. Elite E Services Limited makes no warranties, express or implied, that the information furnished will be furnished or when furnished that it will be current, accurate, and complete, without interruption or error free.
Subscriber understands that neither Elite E Services nor any Authorizing SRO guarantees the timeliness, sequence, accuracy, or completeness of Market Data or of other market information or messages disseminated by any Disseminating Party. Neither Subscriber nor any other person shall hold any Disseminating Party liable in any way for (a) any inaccuracy, error or delay in, or omission of (i) any such data, information or message or (ii) the transmission or delivery of any such data, information or message, or (b) any loss or damage arising from or occasioned by (i) any such inaccuracy, error, delay or omission, (ii) non-performance or (iii) interruption in any such data, information or message, buy any force majors (e.g., flood, extraordinary weather conditions, earthquake or other act of God, fire, war, insurrection, riot, labor dispute, accident, action of government, communications or power failure, equipment or software malfunction) or to any other cause beyond the reasonable control of any Disseminating Party.
Elite E Services Limited provides a 10-Day Trial Subscription to Intrepidus FX. 10-Day Trial users WILL be automatically enrolled in a Subscription package after the 10-Day Trial expiry. Users that would NOT like to continue using Intrepidus FX should speak with a Customer Support representative. Details for subscribing will also be provided to users towards the end of the 10-Day Trial period by email and/or telephone. Billing will recur at the standard rate of $200/month. Said Subscription packages will automatically renew indefinitely unless Subscriber contacts Elite E Services by email or phone at least 5 business days prior to Subscription renewal and explicitly states that he/she would like to discontinue use of Intrepidus FX after the initial term commitment. No refunds will be given if Subscription has already renewed. If the request for cancellation is not received at least 5 business days before the next term begins, your account will be cancelled on the last day of the following term.
All Subscriptions to Intrepidus FX are NON-REFUNDABLE and NON-TRANSFERABLE. No refunds are granted for partial usage of paid Subscriptions.
It is also understood that payment for Intrepidus FX is not disputable on grounds of trading losses. There is always a relationship between high reward and high risk. Any type of market or trade speculation that can yield an unusually high return on investment is subject to unusually high risk.
In the event of any failure by you to make payment, or if you charge-back, you will be responsible for all reasonable expenses (including attorneys' fees) incurred by Elite E Services Limited in collecting such amounts plus interest at the rate of 10% per annum or the maximum amount permitted by law, whichever is greater.
Elite E Services Limited reserves the right to change the rates for Intrepidus FX in its sole discretion.
It is essential that a demo simulation account be first used EXTENSIVELY before commencing trading activity on a Forex trading account using real funds. Intrepidus FX is strictly for use by traders with EXCESS RISK CAPITAL and who are fully aware of the inherent risks involved in Forex trading. The high degree of volatility within the foreign exchange market, and the ability to leverage your position means that losses can be quick and significant. You may lose your entire investment capital. It is your responsibility to ensure that you fully understand these conditions before proceeding further.
Elite E Services Limited End-User Agreement Provisions
1. Ownership. End-User agrees that Elite E Services Limited and its information providers retain all proprietary right, title or interest, including copyright, in the stories, articles or other material, including but not limited to text, images, and other multimedia data, that Elite E Services provides as part of Distributor's Services (the "Content").
2. Restrictions on Use. End-User agrees that it will not copy nor license, sell, transfer, make available or otherwise distribute the Content to any entity or person. End-User shall use its best efforts to stop any such copying or distribution immediately after such use becomes known.
3. No Warranty. The Content is provided "AS IS." Elite E Services and its information providers disclaim any and all warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, relating to this agreement, the content and all performance hereunder. Elite E Services and its information providers make no warranties regarding the completeness, accuracy or availability of the Content.
4. Limitation of Liability. In no event shall Elite E Services or its information providers be liable to End-User or any other person or entity for any direct, indirect, special, exemplary or consequential damages, including lost profits, arising under this Agreement or from performance there under based in contract, negligence, strict liability or otherwise, whether or not they or it had any knowledge, actual or constructive, that such damages might be incurred.
5. Indemnification. End-User shall indemnify and hold harmless Elite E Services and its information providers against any claim, damages, loss, liability or expense, including attorney’s fees, arising out of End-User's use of the Content in any way contrary to this Agreement.
6. Beneficiaries of this Agreement. The rights and limitations in this Elite E Services End-User Agreement are for the benefit of Elite E Services and its information providers, each of which shall have the right to enforce its rights hereunder directly and on its own behalf.
7. Third-Party Use. Intrepidus FX may not be used for any purpose other than personal use. Usage by third-parties and usage on behalf of third parties is strictly prohibited.
8. Limitation on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble Intrepidus FX under any conditions.
9. Introducing Broker Relationship. Elite E Services is an Introducing Broker and acts in this capacity for a market maker. Clients that open trading accounts with said market maker and list Elite E Services as the Introducing Broker may be eligible for special offers or discounts made available by Elite E Services. If the relationship between Elite E Services and said market maker terminates, the benefits of any former special offers or discounts will cease and be considered null and void.
Elite E Services shall not be responsible for any interruptions or delays in transmission, errors, defects in transmission, or failures to transmit information when such result from acts of God, including without limitation to natural disasters, floods, fire, war, riots, earthquakes, hurricanes, electronic equipment failures, telephonic and interconnect problems, communication problems, acts of government or other causes beyond Elite E Services control and the Customer does further hereby waive any claims against Elite E Services for any delay or interruption in service. Without limiting the foregoing, the Customer understands and agrees that Elite E Services, its joint venturers and its and their officers, employees or agents shall not be liable for any incidental, special, indirect, consequential or other damages occasioned by Customer's use of, or reliance upon, the information furnished by Elite E Services. The Customer waives any and all rights the Customer may have to recover any damages, whether incidental, special, indirect, consequential or otherwise, against Elite E Services, its joint venturers and its and their officers, employees or agents, resulting from loss of profits or opportunity, trading losses, or any other damages resulting from inconvenience or the loss of use of Elite E Services service or the Customer's reliance upon the information received from Elite E Services.
Elite E Services may terminate this Agreement with the Customer with cause and such termination shall become effective as of the day such termination is communicated to the Customers. Elite E Services may refuse service to any particular individual, institution or entity for any reason whatsoever. Customer hereby agrees to pay all taxes that may be assessed in any and all transactions resulting from this Agreement or the services provided by Elite E Services, including without limitation federal excise, sales, use, personal property or other applicable taxes. The rights and obligations arising under this contract are personal and the Customer shall not assign, transfer, lease, sublease, in whole or in part, any of the Customer's rights under this Agreement without the prior written consent of Elite E Services.
This Agreement constitutes the entire agreement between Elite E Services Limited and the Customer relating to the purchase of services herein above described. Any covenant or agreement or condition of any part of this Agreement may be amended or revised by Elite E Services Limited at anytime without the express written agreement of End-User parties.
If any of the provisions of this Agreement are determined to be unenforceable by a court of competent jurisdiction, then the portion so held to be unenforceable shall be deemed to the excluded and the remainder of the Agreement shall remain in full force and effect. This Agreement shall be governed by, and construed in accordance with, the laws of the State of New Zealand.
By purchasing a subscription, you are agreeing that you are obligated to this agreement as if you had signed with pen and paper.
